The general agreement of the federal states to introduce a comprehensive sports betting regulation in Germany has met with a positive response. However, similar to the planned casino regulation, it turns out that the providers must expect considerable restrictions. The considerable limitation of the live betting offer is currently viewed particularly critically. A complete ban on live betting no longer seems to be under discussion, but at least the live betting portfolio should be significantly reduced. With live bets, the bookmaker customer places bets during the game. According to the DSWV, around 60 percent of sales are generated with live betting. If live betting in Germany were significantly restricted, bookmakers would have to expect significant financial disadvantages. It is perfectly clear that an industry association cannot welcome such a regulation. But not only the industry representatives, but also many sports betting experts are very critical of the limitation of the live betting portfolio in the form intended.
Just imagine, bookmakers in Germany will only be able to offer a fraction of the current live betting portfolio in the future. That would automatically mean that many sports betting fans could no longer place the beloved live bets, at least not with bookmakers with a German license. Probably then exactly what happened in the past few years would happen: German sports betting fans who like live betting place their bets with bookmakers who are not licensed in Germany because they have the better offer. But that would mean that the German sports betting fans who go this route do not enjoy player protection in Germany. Germany is planning a regulatory authority for sports betting and other games of chance. But, of course, only those providers who submit to this regulation can be regulated. But the internet has no limits and there are, for example, many Asian bookmakers who are just waiting for German fans, who are disappointed by the future regulation, to be won over as customers. Essential goal of regulation in danger?Online bookmakers have been recognized in Germany for several years. The easiest way would be to legalize the previous practice and to recognize sports betting in Germany as well as in other European countries. But the German federal states are obviously not satisfied with this and want to create a regulation that goes far beyond what takes place in other European countries. A good example of this is the planned deposit limit of 1,000 euros per month for bookmakers. This limit is entirely arbitrary. There are no scientific studies to show that a deposit limit of this amount would improve player protection. But it is quite certain that with this deposit limit the sports betting fans, who want to place very high bets at least once in a while, will not be able to use the legal offer in the future. This automatically leads to these sports betting fans looking for other options. Who seriously believes that a high roller who has regularly placed four-digit amounts in sports betting will forego this in the future just because German bookmakers are no longer allowed to accept this bet? The German federal states have also considered that it would be a good idea to completely remove some betting variants from the market. Among other things, the over / under bet should be prohibited. There is no reason why this betting variant, which is extremely popular, should be worse than all the others. In general, the justification for the planned regulation lacks scientificness. Perhaps, in an ideal world, it would actually be an option to massively regulate or even ban gambling altogether. But today's world is far from ideal. It is simply wishful thinking that an unattractive offer would be accepted by bookmaker customers simply if there were all the bets you wanted a few clicks away. That was different in times when the World Wide Web was not available. But nowadays the next offer, possibly in the future without a German license, is only a few seconds away. However, that does not seem to prevent the German federal states from planning regulation that will not solve the basic problem of recent years. The primary and most important goal of the new sports betting regulation should be to convert the existing gray market as completely as possible into a legal market. Self-exclusion list becomes a data monsterThe DSWV fundamentally welcomes the fact that it should be possible in the future to undertake a nationwide self-exclusion from sports betting and other games of chance. But the planned implementation with a centralized database is heavily criticized. The idea of giving every sports betting fan the opportunity to exclude himself from all offers is basically great. With such a list, it would be possible to make real progress in player protection. Sweden also works with a self-exclusion list and it might be a good idea to ask your Scandinavian neighbors how the implementation works best. Sweden also had to make some adjustments after the introduction of the new gambling regulation in 2019. But the self-exclusion list is widely seen as a great success. So why not look at how the Swedes solved this problem? But the German federal states obviously do not need any external input. Instead, there is a huge new agency in the current regulatory proposals, which is said to have a massive database that will not simply find the list of all players who are self-excluding. Instead, all (!) Activities should be registered with bookmakers and casino reviews. which will not just be the list of all players who exclude themselves. Instead, all (!) Activities should be registered with bookmakers and casinos. which will not just be the list of all players who exclude themselves. Instead, all (!) Activities should be registered with bookmakers and casinos. The recording of all bets at bookmakers and in casinos would be necessary if the limit of 1,000 euros per player and month would come. In this case there would probably be no other option than to create a centralized database in which all customer activities of all casinos and bookmakers would be recorded. Only the representatives of the federal states who came up with this data collection probably know how to reconcile this with modern data protection. A simple self-exclusion list would be much easier to implement. Above all, it would not be necessary to record all customers. Once the gambling and sports betting fans in Germany have understood that every small bet on a slot machine should be recorded with name and address, there will probably be a little rebellion anyway. After all, it has been possible in Germany for decades to play in casinos and amusement arcades without going through such data collection. The planned regulation would lead to the data of all sports betting fans being recorded. And all of this should only happen to filter out a small proportion of bookmaker customers who have problems with sports betting? It cannot be that the federal states cannot think of anything better than an Orwell fantasy for the future regulation of sports betting and gambling in Germany. that the data of all sports betting fans would be recorded. And all of this should only happen to filter out a small proportion of bookmaker customers who have problems with sports betting?
